Terms and Conditions

DRAFT FOR LAWYER REVIEW. Version terms-draft-1. Written for review by a licensed attorney before launch. It is not legal advice and has not been approved. The drafts in David's document tabs were not available when this was written, so reconcile them with this text. "Work World" is a temporary name and appears as the brand setting.

1. Who we are and what this is

The app ("the Service") is a network that connects people who need work done with people who do it. We act like a staffing agency and marketplace: we provide the platform, ranks, proof-of-work tools, invoicing and payment routing. People who do work are independent contractors, not employees, unless a separate written agreement says otherwise.

2. Accounts and one account per person

You must be 18 or older to use the professional side. You may hold one account. One account can both post jobs and work jobs; switching between the two does not create a second account. You are responsible for what happens under your login.

3. ID check (KYC) and tax forms

Everyone must provide government ID and the information needed to pay them and to file tax forms (such as a Form 1099): legal name, address, date of birth year and the last digits of a tax ID. We keep the ID number only as a one-way fingerprint plus its last four digits. We may refuse or end an account that fails the check, provides false information, or matches a person we have removed.

4. Military and veterans

A person may submit basic proof of sign-up for military or veteran status through MoselleVA.com. When we verify it, the account starts at a one-star general rank and never ranks below that while the status is verified. We may reject or revoke the status if the proof is false.

5. Ranks, work ethic and fairness

Everyone starts at the lowest rank. Ranks rise with completed jobs and fall with poor work ethic (late work, cancellations, lost disputes, low reviews). Ten completed jobs earns one step, subject to a work-ethic minimum. Powers and access come with rank. There is one six-star per city; it is held by the leading five-star and can be taken by anyone who surpasses the holder. Ranks are calculated by the published formula, from real jobs only.

6. Booked jobs and the cancellation fee

When a job is booked, whoever cancels it pays a cancellation fee set between $25 and $50 (the current amount is shown in the app). The fee falls on the person who cancels, whether that is the person who posted the job, the owner or the worker. There is no fee to withdraw a posting nobody has booked. By creating an account you accept this policy; your acceptance is recorded against your account, email, ID and address and is kept in our ledger.

7. Payments, fees and the deal

Payments run through the payment provider you connect (such as Stripe, PayPal, Square, Venmo or Authorize.net). We never hold your provider password. Territory owners agree to the fee schedule in their plan: a share of billings until the plan price is paid off, then an ongoing franchise fee and platform fee, as stated in the plan you choose. A small share (the performance bonus pool) of money passing through the Service is set aside for the performance bonus described in section 9. Prices and rates are shown in the app and may change with notice.

8. Photo proof, approval and payouts

A job counts toward pay, rank and quotas only after photo proof is uploaded and the work is approved. We may reject work with a stated reason. Approved work is paid out less any amounts you owe (for example fees or the one-time insurance charge).

9. Performance bonus

The performance bonus is based on results (rank, jobs, work ethic, reviews and profile views). Winners are chosen by those numbers, not by chance. It starts only after the number of sign-ups we publish is reached. We record what is collected and what is paid.

10. Insurance

Some jobs, including commercial property, require insurance. Pay-per-job insurance may be offered through partners; having it unlocks those jobs. You are responsible for any coverage you need.

11. Reviews

Reviews must be tied to a real, finished job and may only be left by someone who took part in it.

12. The removal rule: no taking people off the network

You agree not to pitch customers, workers or owners to leave the network so you can deal with them directly, and not to use the Service in a way that avoids the fees it is built on. If we learn this happened (for example from a customer), your account is closed permanently and you may not return under any name, email, phone number, ID or address. We keep a record of the fingerprints needed to enforce this.

13. Location notice (GPS)

If you use a worker link, the app records your location only at the moment you tap In and the moment you tap Out, to record arrival, departure and hours. It does not track your location in the background or during the day. You are told this up front and your agreement is recorded.

14. Texts and email

We send texts and email about jobs, approvals, payments, reminders and, if you agree, cards. Reply STOP to a text to end texts. Every marketing email has an unsubscribe link. Message and data rates may apply.

15. Quotas, cutoffs and waitlists

Territory owners may have a work quota, with a warning before any cutoff. If an owner does not work, we may cut the account off or apply an additional share to their billings. A territory that opens goes first to the next person on its waitlist.

16. Support and disputes

You can contact support from the app. Disputes are reviewed against photo proof and the ledger, which is a permanent, tamper-evident record of payments, fees, approvals, rank changes and changes to territories, quotas and payments, with who made each change and when.

17. Kids' side (future)

A kids' side may be offered later. Children under 13 may only use it with verifiable approval from a parent or guardian, who must sign in and give consent first. We will not collect a child's personal information without that approval. This section will be completed before any kids' feature launches.

18. Ending your account

You may close your account at any time. We may suspend or close accounts that break these terms. Records the law or our ledger requires us to keep stay on file.

19. Disclaimers and limits

[For attorney: warranty disclaimer, limitation of liability, indemnity, arbitration and class-action waiver, governing law and venue (Texas), assignment, severability, notice, changes to terms.]
